1_ PARTIES AND ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS
(hereinafter also referred to as the General Conditions or GTC):
On the one hand, the product supplier, GREENCOURT, SL (hereinafter also referred to as the provider), with registered office at C/ Manolo Hugue, 2, 08182 Sant Feliu de Codines (Barcelona), Tax ID B65971616, customer service phone 936760516, and email: info@greencourt.es, as the owner of the website www.greencourt.es, presents the contractual document that will govern the contracting of products through the aforementioned website.
And on the other hand, the User – Client (hereinafter referred to as the User), registered on the website using a username and password, for which they have full responsibility for use and safekeeping, being responsible for the veracity of the personal data provided to the provider.
BOTH PARTIES ACCEPT the present document, which implies that the user:
_ Has read, understands, and comprehends what is set forth herein.
_ Is of legal age and has sufficient capacity to contract.
_ Assumes all obligations stipulated herein.
_ Has read and accepts these general purchase conditions from the moment any offered product is acquired.
This document can be printed and stored by Users. The provider makes the email address info@greencourt.es available to them for any questions regarding these conditions. These present conditions will have an indefinite period of validity and will be applicable to all contracts made through the provider’s website. The provider reserves the right to unilaterally modify these General Conditions, without this affecting goods or promotions that have been acquired prior to the modification, with the aim of improving the products offered. In any case, these general conditions must be consulted before purchasing the products. It is advisable to keep a copy of the data contained in the purchased products. GREENCOURT, SL is not responsible for any loss of data, files, or any damage resulting from a backup error by the User of the data contained in the acquired products, such as memory cards. GREENCOURT, SL is not responsible for the consequences that may result from improper use of the products sold on the website. The civil liability of GREENCOURT, SL for the supplied products is limited to their amount; the user waives the right to claim any liability from the provider for any reason in any case of dissatisfaction with the products acquired on the website www.greencourt.es, as well as for possible errors, slow access, or errors in accessing the website, including data loss or other types of information that may exist on the user’s computer or network accessing the website. GREENCOURT, SL is a company specialized in the sale, installation, and maintenance of artificial turf for professionals and individuals, urban landscaping, and sports constructions. GREENCOURT, SL sells its products remotely via the Internet through its website and/or by phone. GREENCOURT, SL does not have any physical store for the sale of its products.
2_ SUBJECT OF THE CONTRACT
2.1 Scope of Application: The purpose of this contract is to regulate the contractual purchase-sale relationship established between the provider and the user at the moment the latter accepts these purchase conditions during the online contracting process, by checking the corresponding box. These GTC will apply from the day the order is placed. The contractual purchase-sale relationship involves the delivery of a specific product in exchange for a determined price publicly displayed on the website.
2.2 Territory of Application: The virtual store at www.greencourt.es is active throughout Spain.
2.3 Capacity to Contract: To place an order, one must be of legal age and have the capacity to contract.
2.4 Client Acceptance: The validation of an order through the website www.greencourt.es is carried out by email and also implies the automatic acceptance of the GTC. These conditions are available on the website www.greencourt.es or, if you wish and request it, we can provide them to you by email.
2.5 Modification of the General Terms and Conditions: GREENCOURT, SL reserves the right to make changes and/or modifications to these GTC. We advise our clients to review them regularly. In the event that these changes or modifications are introduced after an order has been placed, the conditions in force on the date the order was made will apply.
3_ INFORMATION PROVIDED ON THE WEBSITE www.greencourt.es
3.1 Price Publication: The prices of the products are those shown for each product on our website www.greencourt.es
3.2 Product Information: The information contained in our advertising, brochures, other written material, on our website, or provided to you constitutes an invitation to make a purchase. The contents of www.greencourt.es are constantly being renewed and updated to offer our clients the most complete and detailed information possible. All contractual information present on www.greencourt.es is displayed in Spanish (Castilian) and communication with clients and users, as well as the formalization of the contract, will be carried out in this language; however, if the client wishes, it can be done in Catalan or another language, always indicating this before initiating the contracting procedure. 3.3 Product Availability: There may be occasions when it is impossible to supply all products because they are not in stock or available at the time of purchase. In such cases, the product in question will be visible but not available for purchase.
3.4 Right of Cancellation: GREENCOURT, SL reserves this action (right of cancellation) for the shipment of a specific product that does not meet the quality requirements imposed on all products of www.greencourt.es
. In the event that this lack of quality is detected, GREENCOURT, SL’s Customer Service will suggest a replacement product, and if the replacement product is not to the client’s liking, the cost of that product will be refunded.
3.5 24/7 Orders: Order reception hours are twenty-four (24) hours, three hundred and sixty-five (365) days a year, although orders placed after eighteen (18:00) hours will not be processed until the next business day in Sant Feliu de Codines. Orders received on Fridays will be processed for delivery on Mondays or the first business day, and those received on Saturdays until 10 AM will be delivered on Mondays (or the next business day). After this time, they will be processed on Mondays and delivered the next business day, for the peninsula and as stipulated in the corresponding section for orders outside the peninsula. 3.6 Fraud: If GREENCOURT, SL suspects or detects any anomaly or fraud, it reserves the right to cancel the transaction for security reasons.
4_ PURCHASE PROCEDURE
In order for the user to access the products offered by the provider, they must register on the website by creating a user account. To do this, the user must freely and voluntarily provide the personal data that will be requested.
The user will select a username and password, committing to diligent use and not making them available to third parties, as well as to notify the provider of their loss or theft or possible unauthorized access by a third party, so that the provider can proceed with their immediate blocking.
The user may not choose as a username words intended to confuse other people by identifying them as an integral member of the provider, as well as offensive, injurious expressions and, in general, those contrary to the law or the requirements of morality and good customs.
Once the user account is created, please note that, in accordance with the requirements of Article 27 of Law 34/2002 on Information Society Services and Electronic Commerce, the contracting procedure will follow the steps below:
Choose the product by clicking the “AÑADIR AL PEDIDO” button, and it will automatically be added to the “carrito de compra”.
If you wish to add more products, you must select the “Otros productos” option. If you have accidentally added an unwanted item, you must click the option to remove it from the shopping cart.
Once the products are chosen, you must click the “REALIZAR PEDIDO” button to place the order. By clicking this option, the purchase confirmation will appear (summary of the order placed, your data, and delivery address).
User credentials will be requested, through three methods:
a. User Registration: if you are not a previously registered user, to make a purchase (this registration is free), you must fill out a data collection form (in which you must accept the Privacy Policy). Once completed, you will receive a registration confirmation email at the indicated email address.
b. If you are already registered and a client: you can access your data by clicking the already registered user button, entering your username and password. You must check the spam and junk mail controls in your email inbox and always verify that the contact details provided are correct.
Once registered, an observations screen will appear, where you can indicate the delivery time; a checkbox that you must tick, as it implies acceptance of these General Contracting Clauses.
To finalize the process, you must click the “Realizar Pedido” button.
In any case, once the contracting procedure is completed, the provider’s contracting platform will inform the user, via email, of all the characteristics, price, transport methods, contracting date, and delivery times of the purchased product.
If there is any type of error in the indicated address or in any other part of the order, you must immediately notify the email address that will appear on the website to proceed with the correction of this error.

5_ SHIPPING

5.2 Shipping Costs: Standard shipping costs will be applied as follows: The amount of shipping costs will be borne by the client.
This information will be provided when the quote is requested.
An email will be sent to the client with the final information on the cost of the products and services along with the amount of the shipping costs.

In this way, the provider assumes no responsibility when the delivery of the product cannot be carried out as a consequence of the data provided by the user being false, inaccurate, or incomplete, or when the delivery cannot be carried out due to causes beyond the control of the shipping company assigned for this purpose, such as the absence of the recipient.
When making the purchase, the shipping and/or collection location is chosen. The order delivery time will be during regular business hours. The carrier will inform the client of the delivery time slot.
Notwithstanding the foregoing, the provider has adopted the measures required of a diligent merchant so that delivery can be made within the agreed time, for which reason no liability can be attributed to the provider. Shipments are only made to destinations in peninsular Spain and the Balearic Islands. GREENCOURT, SL will use all means at its disposal to ensure that your order is delivered within the timeframe indicated on our website on the order confirmation date.
5.4 Delivery Times: The delivery time will be subject to the availability of the product and/or service, according to the destination population and the chosen payment method. This period is understood to apply only if the service availability has been confirmed and the full payment of the order verified. In the case of products not available at the time of purchase, our Customer Service can provide you with availability information.
If you have requested several products in the same order, please note that they may have different availability dates, and in this case, you might receive them on different dates. Please note that, in the event of unavailability of any of the references at the time of shipment, you have the right to cancel the order at any time before its shipment, by contacting our Customer Service via the following email address: compres@greencourt.es
indicating the order number.
5.5 Shipment Confirmation: At the time of handing over the order to our carrier, we will send you the shipment confirmation to the email address you provided when placing the order. In the shipment confirmation, we will provide you with the corresponding tracking number so you can track it through our carrier’s website.
5.6 Damages upon Delivery: Products are sent in secure packaging. If, at the time of delivery, it is visibly and clearly apparent, without needing to manipulate the shipping packaging or the product’s own packaging, that a product has defects caused by transport damage, or if, in the same way, an error is observed in the received merchandise, the client must immediately contact our Customer Service line 936760516 or email info@greencourt.es, in order to request the return of the affected product or products and proceed with their replacement with another in optimal condition or to obtain a refund of the price paid for it, as indicated in this email.
Likewise, if damages to the product are detected once the package is opened and the packaging is in perfect condition, the consumer and user must inform the seller of the lack of conformity within two months from the date of becoming aware of it, by contacting our Customer Service line 936760516 or email compres@greencourt.es.
6_ PRICES
All prices displayed in the www.greencourt.es store DO NOT include the VAT in force at the time of purchase. All prices listed on the website are valid and expressed in Euro (€) currency. These amounts, unless expressly stated otherwise, do not include shipping costs, handling, packaging, shipping insurance, or any other additional service attached to the acquired product or service.
VALUE ADDED TAX: In accordance with the provisions of Article 68 of Law 37/1992, of December 28, on Value Added Tax, the delivery of products shall be understood to be located within the territory of application of Spanish VAT if the delivery address is in Spanish territory, excluding the Canary Islands, Ceuta, and Melilla. The applicable VAT rate will be the one legally in force at any given time, depending on the specific item concerned. For orders destined for the Canary Islands, Ceuta, and Melilla, deliveries will be exempt from VAT in accordance with the provisions of Article 21 of Law 37/1992, without prejudice to the application of the corresponding taxes and tariffs in accordance with the regulations in force in each of these territories.
The user will receive the order invoice at the email address provided by the user once the purchase has been made. The prices applicable to each product will be those published on the website and automatically applied by the contracting process in its final stage. For any information regarding the order, the User may contact the provider’s customer service phone number or via email at the address provided.
7_ PAYMENT METHODS
Below, we detail the available systems:
7.1 Payment by bank transfer or deposit to account: After completing the order, the user will receive an email with the quote, which includes instructions with the account number for payment. It is essential that the assigned order number and the user’s name are clearly indicated on the transfer order. To confirm the order, it will be necessary to accept the quote via email and make the transfer within a maximum period of 7 days; otherwise, it will be canceled in our system.
8_ RIGHT OF WITHDRAWAL
8.1 Right of withdrawal: The user has the right to exercise the right of withdrawal, and for this purpose has a period of 14 calendar days from the receipt of the product, without penalty for its exercise; the consumer must be reimbursed the total amount of the purchase, i.e., the price of the product plus shipping costs, within 14 days following the exercise of the right of withdrawal by the user/consumer. Regarding shipping costs for the return of products, these will be borne by the user-consumer.
The exercise of the right of withdrawal is not subject to any specific formality. The consumer will only be liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods, without thereby limiting their right to exercise this right.
To exercise this right of withdrawal, you may fill out this form (link to the WITHDRAWAL FORM) with your order number (to obtain a refund of the product(s) amount within a maximum period of fourteen (14) calendar days following receipt of the order), along with your contact details. You may send it via email to compres@greencourt.es or by postal mail (by any legally admissible means), always within 14 calendar days from the receipt of the order. After this period, you may only request the return or exchange of the product(s) for technical reasons subject to the warranty of these products.
You must return the product with all the elements with which it was delivered, without damage or signs of wear of any kind, and which do not indicate improper use of the item or use different from its inherent nature, to the address we have provided. It is recommended to return it in its original packaging; if this is not possible, the product may suffer a depreciation in its value. The customer will be responsible for the packaging and protection of the product(s) they send, as well as the shipping costs incurred. Provided that the products are returned within 14 calendar days, without damage or signs of wear and complying with the requirements established in this section, we will refund the total purchase amount.
Exceptions to the right of withdrawal: The right of withdrawal will not apply to contracts relating to:
a) The provision of services, once the service has been fully performed, when the performance has begun with the consumer’s and user’s prior express consent and with their acknowledgment that they are aware that, once the contract has been fully performed by the trader, they will have lost their right of withdrawal.
8.2 Return due to order error by GREENCOURT, SL: If the product does not match the order due to an error attributable to the company, the user must notify the company by email as soon as possible; GREENCOURT, SL will bear the costs of collecting the product sent in error and delivering the correct product corresponding to the order placed.
8.3 Verification of returns: The verification and checking of returned products will be carried out by GREENCOURT, SL, which, once at its facilities, will verify that they are received complying with all the requirements established in section 8.1. Should any elements be missing, we will inform you in writing via email, indicating the missing content.
9_ REFUNDS
When a return occurs (the right of withdrawal is exercised), the amount paid for the product plus shipping costs will be refunded. Return shipping costs will be borne by the consumer-user. The maximum period for the refund will be 14 calendar days and will be processed using the same payment method used for the purchase.
10_ APPLICABLE WARRANTIES AND AFTER-SALES SERVICES
10.1 Warranty: All products offered through the website are completely original, unless otherwise indicated in their description.
Satisfaction Guarantee: If, upon receiving the product and before exercising the right of withdrawal, the user is not satisfied with the purchase, they may choose to exchange the item for another. If the price of the product is higher than that of the exchanged product, the user must pay the difference.
10.2 Warranty in case of defective product: In case of a defective product, GREENCOURT, SL must proceed with its repair, replacement, price reduction, or contract termination (as appropriate), actions which will be free of charge for the user. GREENCOURT, SL is responsible for any lack of conformity that becomes apparent within the period indicated by the manufacturer’s warranty; the consumer-user must inform GREENCOURT, SL of the lack of conformity within fifteen days of becoming aware of it.
11_ NULLITY AND INEFFECTIVENESS OF CLAUSES
If any clause included in these General Conditions is declared, totally or partially, null or ineffective, such nullity or ineffectiveness shall affect only that provision or the part thereof that is null or ineffective, with the General Conditions remaining in force in all other respects, and the affected provision, or the part thereof, shall be deemed not to have been included.
12_ ONLINE DISPUTE RESOLUTION
(ONLINE DISPUTE RESOLUTION)
In accordance with Article 14.1 of Regulation (EU) 524/2013, the European Commission provides a free-access platform for online dispute resolution between the USER and the PROVIDER, without the need to resort to courts of justice, through the intervention of a third party, called a Dispute Resolution Body, which acts as an intermediary between both parties. This body is neutral and will dialogue with both parties to reach an agreement, potentially suggesting and/or imposing a solution to the conflict. 13_ APPLICABLE LAW AND JURISDICTION
These conditions shall be governed by or interpreted in accordance with Spanish law in all matters not expressly established herein. The provider and the user agree to submit any dispute that may arise from the provision of the products or services subject to these Conditions to the Courts and Tribunals of the provider’s domicile (if not considered a consumer for the purposes of the TRLGDCU) or the user’s domicile (if considered a consumer for the purposes of the TRLGDCU).
14_ APPLICABLE REGULATIONS
These General Conditions are subject to the provisions of:
European regulations governing e-commerce: Directive 97/7/EC on the protection of consumers in respect of distance contracts (Distance Selling Directive). Directive 2000/31/EC on certain legal aspects of information society services, in particular electronic commerce in the Internal Market (E-commerce Directive).
Spanish regulations: Law 3/2014, of March 27, which amends the revised text of the General Law for the Defense of Consumers and Users. Law 7/1998, of April 13, on General Contract Conditions, and subsequent amendments.
